Please read these Terms and Conditions (“Terms”) carefully before using this Website (www.catherinestringer.com.au) (“Website”). By using or accessing this Website, you are agreeing to comply with and be bound by the following Terms, which together with our Privacy Policy form the “Agreement” which governs your use of this Website. If you do not agree to all the Terms in this Agreement, you may not use or access the services.

In order to use our Website you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding Agreement. You are not permitted to use this Website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.     

2.       Limitation of Liability

Your use of or reliance on any information or material on this Website is entirely at your own risk for which Catherine Stringer Artist shall not be liable.

Catherine Stringer Artist assumes no liability for any errors, mistakes or inaccuracies of content; personal injury or property damage of any nature whatsoever resulting from using our Website; and any unauthorised access to or use of our secure servers and/or any and all personal information stored there.

Catherine Stringer Artist shall in no event be liable for any actions, claims, losses, liability, damages or expenses arising as a result of using, or inability to use, this Website.

Catherine Stringer Artist disclaims all warranties expressed or implied, including but not limited to, implied warranties of merchantability and fitness for any particular purpose, that the documents, goods or services will be free of errors, or that defects will be corrected, or that our Website or its server is free of viruses or any other harmful components. 

3.    Amendment of Terms

We reserve the right to change, modify, add or remove portions of these Terms at any time at our sole discretion. You should therefore review these Terms periodically prior to using our Website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. Your continued use of this Website will be regarded as conclusive evidence of your Agreement and acceptance of the new Terms.

We reserve the right to change the services, stop providing the services or part of the services, create limits for the services, change the price of products or services, or temporarily or permanently terminate or suspend access to the services without notice or liability. 

4.     Sales and Delivery

We use third party payment processors (each a “Payment Processor”) for payment of goods and services. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor, in addition to this Agreement. Our current Payment Processors are Stripe and PayPal, and your payments are processed by Stripe and PayPal in accordance with their terms of service and privacy policy.  We reserve the right to correct, or to instruct our Payment Processor to correct, any errors or mistakes, even if payment has already been requested or received.

Physical goods are processed promptly upon receipt of full payment. Where possible this is within 2-5 business days. Goods are delivered by Australia Post or other reputable courier companies. Delivery times will vary.

Goods are securely packed and insured against damage. Catherine Stringer Artist is not responsible for goods that are damaged in transit or not received. Damaged or lost items should be resolved with Australia Post or the courier company directly. Replacement of damaged or lost items is made at the discretion of Catherine Stringer Artist. 

5.    Returns and Refunds

Returns and Refunds are processed in accordance with Australian Consumer Protection legislation. Requests for refunds for undamaged items must be notified within 7 days of receipt of goods. Full refund will be issued on timely return of undamaged items in original packaging. Customers will be responsible for costs of return shipping of products. We reserve the right to refuse the return of any items which have been damaged in return transit due to insufficient packaging. Refunds will be processed promptly and issued via the same method used to make payment. 

6.    Copyright

The online content of this Website is protected by copyright. This includes without limitation all documents, information, text, design, images, video, graphics, logo, photographs, audio, video and music.

Except as permitted by the copyright law applicable to you, you may not reproduce or communicate any of the content on this Website, including files downloadable from this Website, without the written permission of Catherine Stringer Artist.

The Australian Copyright Act allows certain uses of content from the internet without the copyright owner’s permission. 8.       Jurisdiction

This Agreement and this Website are subject to the laws of Tasmania and Australia. Any dispute between you and Catherine Stringer Artist must submit to the jurisdiction of the courts of Tasmania.
